## 1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

These Terms apply to all users, including free and paid subscribers. Additional terms may apply to specific features, promotions, or add‑ons, and will be presented at the time you use those features.

GLP‑1 Assist provides a personal tracking and organization tool designed to help individuals stay consistent with routines and better understand their personal patterns over time. Features may include, for example:

- Injection tracking and reminders  
- Symptom and side‑effect logging  
- Body metrics and progress photo documentation  
- Meal logging, food entries, and recipe organization (including manual entry)  
- Pattern recognition and insights (including optional AI‑assisted insights)  
- Shareable summaries (optional)  
- Educational content and community features  
- “Link‑Out” functionality to third‑party recipe or video sources  

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.

## 3. Medical Disclaimer

**IMPORTANT MEDICAL DISCLAIMER**

GLP‑1 Assist is a personal tracking and organization tool. **It is not a medical device** and **does not provide medical advice, diagnosis, or treatment**. Any insights, summaries, or recommendations are provided for informational purposes only.

### Healthcare Provider Relationship

You acknowledge and agree that:

- GLP‑1 Assist does not replace the relationship between you and a licensed healthcare provider.  
- You should always seek the advice of qualified professionals for medical questions.  
- You should not delay seeking care or disregard professional advice based on information from the Services.  
- In an emergency, call emergency services immediately.  

### User Responsibility

You are responsible for the accuracy and completeness of information you enter into the Services and for how you use any outputs or insights.

## 4. User Accounts and Responsibilities

### Account Creation

To use certain features, you must create an account. You agree to:

- Provide accurate, current, and complete information  
- Maintain the security of your credentials  
- Promptly update information as needed  
- Accept responsibility for activities under your account  
- Notify us immediately of unauthorized access or use  

### Age Requirements

You must be at least 18 years old to use the Services. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.

### Account Termination

You may delete your account through your account settings (if available). We may suspend or terminate your access if you violate these Terms or if your conduct is harmful to the Services, other users, or third parties.

## 5. User‑Generated Content & Copyright (Manual Entry / Community)

### 5.1 Definitions

“**User Content**” means content you submit, post, upload, paste, type, or otherwise provide through the Services (including recipe notes, meal entries, comments, images, and links). User Content may include content you created and/or content you obtained elsewhere.

### 5.2 Your Responsibility for User Content

You are solely responsible for your User Content and for ensuring it does not violate any law or infringe any third‑party rights. You represent and warrant that you have all necessary rights, permissions, and licenses to submit and use your User Content in connection with the Services.

### 5.3 Recipe and Food Content Standards (Manual Entry)

We respect the rights of creators and expect users to do the same. When using manual entry or community features:

- **Ingredients and factual data:** Ingredient lists, nutrition facts, and other factual data are generally considered factual information and may be recorded for personal logging and organization.  
- **Narrative instructions and expressive text:** Headnotes, stories, and substantial narrative instructions may be protected by copyright. **You agree not to copy and paste substantial copyrighted expressive text (including narrative recipe instructions) from third‑party sources without permission.**  
- **Best practice:** Where you are saving a recipe from a third‑party source, we encourage you to **use a link to the original source** and/or **summarize steps in your own words**, rather than reproducing third‑party expressive text.  

### 5.4 License You Grant to GLP‑1 Assist

You retain ownership of your User Content as between you and GLP‑1 Assist. However, by submitting User Content through the Services, you grant GLP‑1 Assist a non‑exclusive, worldwide, royalty‑free license to host, store, reproduce, process, display, and otherwise use your User Content **solely to operate, provide, secure, and improve the Services**, including generating summaries, insights, and user‑requested exports.

If you share User Content in community features (if offered), you also grant the limited right for that content to be displayed to other users consistent with your sharing settings.

### 5.5 Content Moderation; Removal

We may (but are not obligated to) review, monitor, or remove User Content at our discretion, including if we believe it violates these Terms, applicable law, or third‑party rights. We may remove content without prior notice.

### 5.6 DMCA Notice & Takedown Policy; Repeat Infringers

GLP‑1 Assist responds to notices of alleged copyright infringement and, where appropriate, removes or disables access to allegedly infringing material.

**Submitting a DMCA Notice.** If you believe content on the Services infringes your copyright, send a notice to our designated agent at:

Your notice should include, at minimum:

1. Identification of the copyrighted work you claim has been infringed.  
2. Identification of the material you claim is infringing and information reasonably sufficient to locate it (e.g., in‑app reference, screenshot, or URL/context).  
3. Your contact information (name, address, phone number, and email).  
4. A statement that you have a good‑faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.  
5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.  
6. Your physical or electronic signature.  

**Counter‑Notice.** If you believe your content was removed by mistake or misidentification, you may submit a counter‑notice to the same email address with the information required by applicable law.

**Repeat Infringers.** We maintain a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers.

## 6. Third‑Party Links & Social Media (Link‑Out)

The Services may allow you to store, display, or follow links to third‑party websites, applications, or platforms (e.g., TikTok, Instagram, YouTube) for recipe instructions, videos, or other content (“**Third‑Party Services**”).

- **No endorsement / no control.** We do not own, control, or endorse Third‑Party Services, and we are not responsible for their content, policies, or practices.  
- **Link‑Out functionality.** When you use a link‑out feature, you are leaving GLP‑1 Assist and your use of Third‑Party Services is governed by their own terms and privacy policies.  
- **Availability and accuracy.** We do not guarantee Third‑Party Services will be available, accurate, or up to date, and we are not liable for issues arising from your use of them.

## 7. AI Features & AI‑Generated Content

### 7.1 AI Features Generally

Certain features may use machine‑learning or AI systems to help you organize information, generate summaries, identify patterns, or create illustrative images (collectively, “**AI Features**”).

### 7.2 Accuracy Disclaimer; No Reliance

AI is probabilistic and may produce errors, omissions, or unexpected outputs. You should verify important information (including nutrition estimates, ingredient lists, and serving sizes) against reliable sources (such as product packaging, labels, or the original linked recipe/source). **Do not rely on AI outputs for medical decisions.**

### 7.3 AI‑Generated Images (Illustrative Only)

If the Services generate images of food or meals, those images are **for illustrative purposes only** and may not reflect the actual finished dish, ingredients, or preparation method.

### 7.4 Ownership and Rights (Inputs/Outputs)

As between you and GLP‑1 Assist:

- You retain rights in the **inputs** you provide to the Services (subject to the license you grant us in Section 5.4).  
- To the extent GLP‑1 Assist has any rights in **AI‑generated outputs** created specifically for you through the Services, GLP‑1 Assist assigns those rights to you for your personal use, subject to these Terms and any applicable third‑party rights.  

### 7.5 Prohibited Use of AI Features

You agree not to use AI Features to generate or attempt to generate content that infringes intellectual property rights, violates law, or violates these Terms (including content designed to impersonate others or mislead users).

## 8. Acceptable Use Policy

You agree not to use the Services to:

- Violate any applicable law or regulation  
- Submit or share false, misleading, or unlawful content  
- Provide medical advice to other users as a substitute for professional care  
- Upload malicious code or attempt to disrupt the Services  
- Access other users’ accounts or private data without authorization  
- Use the Services for unauthorized commercial purposes  
- Harass, abuse, or harm others  
- Share copyrighted material without permission (including copying substantial expressive recipe text)  
- Reverse engineer, copy, or misuse the Services or underlying systems  
- Scrape, crawl, or systematically extract data from the Services except as permitted by law or with our written consent

## 9. Subscription and Billing

### Subscription

GLP‑1 Assist may offer paid subscription plans and free trials. Plan features and pricing are described at the point of purchase.

### Billing and Payment

For paid subscriptions:

- Subscriptions are billed monthly or annually based on your selection.  
- Payment is due in advance and may be automatically charged to your payment method.  
- Fees are non‑refundable except as required by law.  
- We may change prices with at least 30 days’ notice.  
- Failed payments may result in suspension of paid features.  

### Cancellation

You may cancel at any time. Access to paid features continues until the end of the current billing period, after which paid features may be suspended unless you resubscribe.

### Free Trial (if offered)

If a free trial is offered, trial terms will be disclosed at sign‑up. If you do not convert to a paid subscription at the end of the trial, paid features may end.

## 10. Intellectual Property

### GLP‑1 Assist Property

The Services (including software, design, text, graphics, logos, and functionality) are owned by GLP‑1 Assist or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services.

### Feedback

If you provide feedback or suggestions, you grant us the right to use, modify, and incorporate that feedback without compensation or attribution.

## 11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of information is governed by our Privacy Policy, incorporated into these Terms by reference.

By using the Services, you consent to the collection and use of your information as described in the Privacy Policy, including processing necessary to provide requested features (and, if enabled by you, AI Features).

## 12. Limitations of Liability

**DISCLAIMER OF WARRANTIES**  
The Services are provided **“as is”** and **“as available”** without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error‑free, or completely secure.

**LIMITATION OF LIABILITY**  
To the fullest extent permitted by law, GLP‑1 Assist will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.

**MAXIMUM LIABILITY**  
Our total liability for all claims arising from or relating to the Services will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or **$100**, whichever is greater.

## 13. Termination

### Termination by You

You may terminate your account at any time through account settings (if available) or by contacting support.

### Termination by Us

We may suspend or terminate your access immediately, without prior notice, if you:

- Breach these Terms  
- Engage in conduct harmful to the Services or other users  
- Violate applicable law  
- Fail to pay required fees (for paid plans)  

### Effect of Termination

Upon termination, your right to use the Services ceases. We will delete your account and associated data within a reasonable period (generally within 30 days), unless we are legally required to retain it longer.

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms and/or by email or in‑app notice. Continued use after changes take effect constitutes acceptance.

## 15. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict‑of‑law rules.

Any disputes arising under these Terms will be resolved through **binding arbitration in New York**, except that either party may seek injunctive relief in court.
